Terms and Conditions

This web page and all the information, content, advice, products and services contained and provided on or through it (“the Site”) is owned, produced and maintained by Meg Tsukada (we, us and ours). In these terms and conditions references to “you” and “your” are references to the person visiting the Site and/or, where the visit is being made on behalf of a limited company, the relevant company.

1. Your agreement with Meg Tsukada

1.1 Your use of the Site constitutes acknowledgment of and an agreement to be bound by these terms and conditions. You should read these terms and conditions carefully and ensure that you understand their consequences before proceeding to use the Site.
1.2 You should check these terms and conditions each time you visit the Site as amendments may be made to them from time to time. Unless otherwise stated, amended terms will be effective when posted but will not affect your rights or obligations in relation to any visits to the Site made prior to the relevant posting.
1.3 You will need to pay part of the consulting fee before the consultation and provide a new ID and password for your account before the session. Until you share the information, I do not start working on your project.
1.4 If you have any questions or concerns about the service, you should contact me before the consulting service starts. We cannot refund the consulting fee after the consultation.

2. Information Contained in the Site

2.1 The Site contains various free advice, information and links to other websites which may be of interest (“the free data and resources”).
2.2 The aim of the free data and resources is to provide preliminary identification of, and basic information on, topics. They are designed to be of general interest to you.
2.3 Meg Tsukada will use its best endeavours to ensure that the Free data and resources are drafted, produced and maintained with all due skill and care. However, the Free data and resources do not form any contract with Meg Tsukada and Meg Tsukada does not hold any of duty of care towards anyone reading or otherwise utilising the Free data and resources.
2.4 The Free data and resources are published by way of general guidance only and are not meant to advise upon the specific legal issues arising in any individual case for which specific legal advice should always be sought. No liability can therefore be accepted for your failure to seek formal advice relating to your legal issues.

3. Exclusion of liability

3.1 To the fullest extent allowed by law, Meg Tsukada will not be responsible in contract, tort (including negligence) or otherwise for any indirect, consequential, special or incidental damage or loss arising from your use of the Site including (but without limitation) any loss or corruption of data, loss caused by a virus, loss of business or profit or anticipated savings, loss or damage to property, fines or penalties levied by any taxing or other authority, or any loss or damage to any third party.
3.2 Meg Tsukada will use reasonable endeavours to ensure that the Site is protected from viruses. However, we cannot guarantee that this is the case and it is recommended that you use your own virus-free protection software. We cannot accept responsibility for any loss or damage to computer systems as a result of a virus or any other effect upon downloading any information from this website or receiving any email from us.
3.3 You acknowledge that email messages sent over the internet are not encrypted and are not secure. You accept that Meg Tsukada cannot be held liable for any breaches of confidentiality that may occur as a result of the use of email. If there is any sensitive or confidential information which you do not wish to communicate by email, please contact us by telephone or post to arrange an alternative method of communication.

4. Intellectual property and ownership

4.1 Meg Tsukada is the exclusive owner of the Site and all database rights, patent rights, and other intellectual property rights relating to the Site and its content, documents, data, design, text, images, graphics, layout, functioning, software (including applets) and source code. All rights relating to the Site are reserved.
4.2 The following uses of the Site are strictly prohibited: Any sale, licensing, rental, distribution and any publication, posting, framing, reverse engineering or modification of or derivative works from the Site.

5. Privacy and confidentiality

5.1 Save for those details divulged (with your express consent) to Referral Solicitors, all personal details and information held by Meg Tsukada are treated as strictly confidential and are not provided to any third parties.

5.2 All id and password you will create for my consulting services will be deleted once our contracts finish. You have a responsibility to de-activate the id on your account.

6. Complaints

6.1 If you have any complaints in relation to Meg Tsukada and/or the Site, please contact us using the details in the Contact section of the Site.

7. Suspension and termination

7.1 Meg Tsukada reserves the right to suspend or terminate your access to the Site at any time.

8. Jurisdiction

8.1 The laws applicable to the Site are the laws of Japan.
8.2 Any dispute in relation to these terms and conditions and/or the Site will be under the exclusive jurisdiction of the Japanese courts.

9. Entire agreement/severability

9.1 These terms and conditions form the whole of your agreement with Meg Tsukada in relation to your use of the Site and supersede any prior representations, inducements or agreements relating to its subject matter.
9.2 Should the courts strike-out as invalid or unenforceable or otherwise alter any part of these terms and conditions, the remaining terms and conditions shall remain valid and in force.
